ZUBITSKIDS REFUND, RETURN & CANCELLATION POLICY

• Standard Marketplace Items (Modalyst): 10 days from delivery.

• Custom & Printed Items (Printify): Final sale (eligible for replacement/refund only if damaged or defective).

• Digital Products (Downloads):Final sale / No refunds.

• Damaged or Defective Items (All Products): Must be reported within 3 days of delivery.

1. Standard Marketplace Items (Apparel, Accessories, Goods)

For standard, non-custom items ordered from our marketplace catalog:

• Return Window: You have 10 days from the date your package was delivered to request a return.

• Item Condition: To be eligible, your item must be completely unused, unworn, unwashed, and in the same condition that you received it, with all original tags securely attached.

• Exclusions: Sale items, clearance items, and gift cards are final sale and cannot be returned.

2. Custom & Print-on-Demand Items

Products that are custom-printed, embroidered, or made-to-order just for you (such as custom graphic tees, mugs, or phone cases) cannot be returned or exchanged for buyer’s remorse (e.g., ordering the wrong size, changing your mind, or color preference).

3. Digital Products

Due to the digital nature of our downloadable products (including but not limited to ebooks, templates, guides, digital art, and files), all digital sales are final. Once a digital product is purchased, downloaded, or accessed, it cannot be physically returned or revoked. Therefore, we do not offer refunds, returns, or exchanges for digital items under any circumstances.

🛑 Damaged, Defective, or Incorrect Items (All Products)

If your item arrives damaged, defective, or if you received the wrong product, we will make it right at no cost to you.

1. You must notify us within 3 days of delivery.

2. Email us at nicole@zubitskids.com.

3. You must include high-quality photos showing the damage, the print defect, or the incorrect item, along with your order number.

4. Once verified, we will arrange for a brand-new replacement to be shipped to you or issue a full refund. You do not need to ship damaged items back.

🔄 How to Request a Return (Standard Items Only)

Do not return your package to the address listed on your shipping label. That is a processing warehouse and cannot accept returns. To start a return:

1. Send an email to nicole@zubitskids.com with your Order Number and the reason for the return.

2. If your return is approved, our support team will email you the exact, designated return shipping address.

3. Pack your item securely and mail it to the provided address.

🚚 Return Shipping Costs

Customers are responsible for paying all return shipping costs. Shipping costs are non-refundable. We strongly recommend using a trackable shipping service or purchasing shipping insurance. We cannot issue a refund if your returned package is lost in transit.

💰 Refunds & Processing

Once your return is received and inspected by our warehouse team, we will send you an email notifying you of the approval or rejection of your refund. If approved, your refund will be processed automatically, and a credit will be applied to your original method of payment within 5–7 business days.

We sell a combination of retail marketplace items, custom-made print-on-demand items, and digital downloads.

• Modifications & Discontinuation: We reserve the right to modify or discontinue any product, service, or price at any time without notice.

• Colors and Images: We make every effort to display the colors and images of our products as accurately as possible. We cannot guarantee that your computer monitor's display of any color will be perfectly accurate.

• Supplier Fulfillment: Because we partner with global suppliers (including Modalyst and Printify), orders are subject to item availability. In the rare event that an item is out of stock after order placement, we will cancel the order and issue a full refund.

3. Digital Products and Intellectual Property

• License for Use: When you purchase a digital product (e.g., templates, downloads, ebooks), we grant you a single, non-exclusive, non-transferable, revocable license for personal or limited commercial use as specified on the product page.

• Restrictions: You are strictly prohibited from copying, reselling, distributing, sharing, or sub-licensing any digital products purchased from our storefront to any third party. All intellectual property remains the exclusive property of ZubitsKids LLC.

4. Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, so that we can complete your transactions.

5. Shipping and Delivery

Shipping times provided at checkout are estimates only and are not guaranteed. Because products are shipped directly from fulfillment centers worldwide, orders with multiple items may arrive in separate packages at different times. We are not responsible for delivery delays caused by customs processing, postal strikes, or incorrect shipping addresses provided by the buyer.

6. Returns, Refunds, and Replacements

All purchases are subject to our official Return & Refund Policy. Standard physical goods follow a strict 10-day return window. Custom print-on-demand items and digital products are final sale and non-refundable unless they arrive damaged or defective.

7. Prohibited Uses

In addition to other prohibitions as set forth in the Terms, you are prohibited from using the site or its content: For any unlawful purpose or to solicit others to perform unlawful acts; To infringe upon or violate our intellectual property rights or the intellectual property rights of others; To submit false or misleading information; To upload or transmit viruses or any other type of malicious code that will affect the functionality or operation of the Service or website.

In no case shall ZubitsKids LLC, our directors, officers, employees, affiliates, or suppliers (including Modalyst and Printify) be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind—including lost profits or lost data—arising from your use of any of our services or products.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New York, USA.
